A Sault Ste. Marie man recently convicted for trafficking large quantities of cocaine has been charged again — this time with threatening to kill someone.
Court documents show Dereck Maione was arrested and charged on the morning of April 24 with uttering threats and breaching a conditional sentence order.
On April 23 at approximately 1:28 p.m., Sault Ste. Marie Police Service attended the Tim Hortons at Second Line West and Farwell Terrace in response to a report of uttering threats.
When police arrived, Ernest Caputo told them Maione was following him and said Maione was going to kill him. Maione left the scene after Caputo showed him he was on the phone with 911.
A subsequent investigation by police “revealed grounds for the charge of uttering threats,” court documents show.
Police also filed a breach of conditional sentence against Maione for failing to keep the peace and be of good behaviour, in addition to uttering threats.
The 32-year-old was held in custody pending a bail hearing. The allegations have not been tested in court and Maione is considered innocent until proven guilty.
This is not the first time Maione has been in trouble with the law.
He was handed an 18-month conditional sentence order in Ontario Superior Court on March 17 after being convicted of possessing cocaine for the purpose of trafficking.
In the early morning hours of Oct. 26, 2021 the Sault Police Service responded to reports of a break and enter in progress in the 0-100 block of Wellington Street East, and that the people inside had a gun.
Officers observed a black BMW parked in the driveway of the residence upon arrival. Three individuals, including Maione, were inside the car and placed under investigative detention.
During a subsequent search of the area, police located approximately 470 grams of a substance believed to be cocaine, 25.58 grams of a substance believed to be crack cocaine, a quantity of Canadian currency and a canister of bear spray.
The estimated street value of the narcotics seized by police was $50,843. The BMW also ended up being seized.
Maione was slapped with a 10-year weapon ban and ordered to provide a DNA sample — on top of his conditional sentence — upon conviction.
The next hearing for Maione is scheduled for May 14.
