Repeat offender gets 90 days for violating orders to stay away from victim

​​David Rous had just finished serving time for assaulting a woman when he was again nabbed for offences involving the same victim.

The 35-year-old was released from jail at the end of January, and days later on Feb. 3 he was again arrested for violating court orders that prohibited him from having any contact with her.

Rous pleaded guilty Tuesday to three counts of breaching probation when he appeared in a Sault Ste Marie courtroom.

At the time of the offences, he was bound by three separate probation orders stemming from three occasions when he was convicted of charges involving the woman.

Ontario Court Justice Melanie Dunn heard city police responded to a 2:20 p.m. call at a Bruce Street address the woman frequented.

Rous was spotted leaving the back of the residence and was arrested, assistant Crown attorney David Didiodato said.

His previous convictions have resulted in lengthier sentences each time he's back in court for similar offences, the prosecuter told the court.

Defence lawyer Ken Walker and the Crown jointly recommended 90 days behind bars.

Didiodato said he wasn't seeking further probation since Rous had just been given a three-year order in January.

With the credit he received for the equivalent of 26 days he has spent in pre-sentence custody, Rous faces a further 64 days in custody.

Walker said his client, a father of two, suffers from a mental health disability.

Rous was at the address to get his clothes, the defence explained.

When she imposed the sentence, Dunn called his actions involving the same woman aggravating. 

His guilty pleas are an indication of remorse, she also said, noting his mental health issues.
