Reports of a tilted load lead to charges for commercial vehicle driver

GARDEN RIVER FIRST NATION - On Jan. 4, 2020 at approximately 5:10 p.m. members from the Sault Ste. Marie Ontario Provincial Police (OPP) Detachment received multiple traffic complaints regarding a Commercial Motor Vehicle (CMV) and its load. Initial reports stated the load was extremely tilted to one side.

Officers located the CMV and conducted a traffic stop on Highway 17, Garden River First Nation, Ont. A level 2 inspection was conducted on the CMV and its trailer. As a result of the investigation, the driver was charged with the following:
  • Operate unsafe vehicle, contrary to section 84 of the Highway Traffic Act (HTA),
  • Drive Commercial Motor Vehicle with major defect, contrary to section 107(11) of the HTA,
  • Fail to maintain daily log, contrary to section 190(3) of the HTA. 
The co-driver was also charged with: 
  • Fail to maintain daily log, contrary to section 190(3) of the HTA.
The owner of the company was also charged with the following:
  • Permit operation of unsafe vehicle - Commercial Motor Vehicle, contrary to section 84 of the HTA.

The accused are scheduled to appear at the Provincial Offences Court on March 4, 2020 located at 99 Foster Drive, Sault Ste. Marie, Ontario.
